1, DEFINITIONS

In this Agreement, unless the context clearly indicates otherwise, the following words and expressions shall have the meaning ascribed:

“Agreement” refers to the following terms and conditions of entry;

“Event” refers to Lost Paradise 2023;

“Organiser” refers to LOST PARADISE GLENWORTH VALLEY PTY LIMITED and its officers, employees, agents and contractors;

“Landlord” refers to GLENWORTH VALLEY LEISURE PTY LTD and its officers, employees, agents and contractors;

“Venue” refers to Glenworth Valley;

“Lease” refers to the lease agreement between the Organiser and the Landlord;

“Ticket Holder” refers to all persons attending the Event.

 

2, TERMS

Certain sections of this Agreement may or may not apply to you depending on the nature of entry and/or participation in the Event, however different sections of the Agreement may and can apply to you concurrently as relevant to you, or intermittently if the nature of your participation in the Event changes.

The Organiser and the Landlord are providers of recreational services and activities as defined under the Civil Liability Act. You are warned, acknowledge and accept that the Venue is an inherently dangerous place that contains all manner of obstacles, risks and dangers, both known and unknown, natural and man made which may result in loss or damage to your property, personal injury or even death. Knowing this to be the case, if you choose to come onto this property you do so at your own risk and to the extent permitted by law, you release and indemnify the Organiser and the Landlord (and its officers, employees, agents and contractors) from and against any claim or liability of any nature in relation to injury or death, from you or any third party which might arise from entry to, or the use of, the Venue by you and any accompanying persons and/or minors regardless of how the damage, injury or death is sustained or caused

Any provision of the conditions of entry which are or become unenforceable shall not invalidate the other provisions of this Agreement.

You, and all other attendees to the Venue, acknowledge and agree that the Organiser has exclusive occupation and control over all areas used in relation to Lost Paradise 2023 at Glenworth Valley under a lease with the Landlord (“Lease”), and that the Lease effectively makes the Organiser, among other things, responsible for the safe operation and maintenance of the Venue, the conduct of people in the Venue and events that take place on the Venue. To this end, you must not do anything which would result in the Organiser to be in default under the Lease, and you acknowledge that a breach by you of these Conditions of Entry will likely have the effect of causing the Organiser to be in default under the Lease.

 

3, GENERAL

Lost Paradise is a drug free event and condemns all illegal drug use. Possession, sale or use of illegal drugs or illicit substances is strictly prohibited at the Event. Any persons found with illegal drugs or illicit substances in their possession will be removed from the Venue and subject to police action.

Protest and political paraphernalia and banners are not permitted at the Event. The Organiser reserves the right to remove any person in possession of or displaying these items, or any item which is deemed racist, vilifying, sexist and/or offensive.

Footwear must be worn at all times during the Event.

Small still cameras are permitted but professional audio or video recording devices, including GoPros, and professional still cameras are prohibited. Ticket Holders are not permitted to record the Event (audio or video) for commercial purposes.

All Ticket Holders consent to be included in any official photography, filming & sound recording by the Organiser and/or any of its authorised representatives and contractors, and grant the Organiser the right to use such recordings for promotion and other purposes.

The Organiser reserves the right to refuse a Ticket Holder admission to the Event and/or to evict any person from the Event if they are affected by alcohol or drugs, or act in contravention of any of these Terms and Conditions.

Activities such as moshing, crowd surfing, climbing and stage diving are strictly prohibited. Ticket Holders engaging in these or other dangerous activities will be removed from the Venue, and Ticket Holders accept all risk and liability for any injuries or damages caused by these activities. Entry to the Venue is at the Ticket Holder’s own risk.

Ticket Holders acknowledge that there may be restricted capacities at some of the Event’s stages, and ticket purchase does not guarantee entry to these areas in such circumstances. Once it is determined by the Organiser (at its sole discretion) that the maximum capacity has been reached in these areas, there will be no further admissions.

Ticket Holders must not cause damage to, improperly use, or tamper with any facilities or infrastructure, or cause any damage to flora and fauna on or surrounding the Venue. Ticket Holders must not remove or attempt to remove any item or object from the Venue or surrounding area. Ticket Holders accept full liability and responsibility for any loss or damage caused in contravention of this clause or any other terms of these terms and conditions.

Ticket Holders will be removed from the Venue if, in the opinion of the Organiser, they behave or act in a threatening or inappropriate manner, including without limitation, any aggressive, riotous, abusive, offensive, racist, sexist or insulting actions towards other patrons, staff or any other persons at the Event. Ticket Holders are required to follow the reasonable directions of the Organiser and Event staff at all times.

Tickets may not be resold or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a ticket is sold or used in breach of this condition, the bearer of the ticket will be refused admission to the Venue and the Organiser may take further legal action against any parties that have breached this condition.

Except where liability cannot be excluded by law, the Organiser (and its employees, contractors and agents) shall not be liable for any loss, cost, expense, injury, claim or damages suffered or sustained by any Ticket Holders at the Event. Where permitted under the Australian Consumer Law (ACL), the Organiser limits its liability in respect of breach of any statutory guarantee under the ACL in the manner set out in sections 64A(1)(a) and 64A(2)(a) of the ACL.

To the full extent permitted by law, Ticket Holders waive all legal rights of action against and fully release the Organiser, its agents, employees and volunteers for all claims for compensation for loss, damage, injury or death howsoever arising out of or in relation to the Ticket Holder’s entry to and presence at the Venue and their attendance at the Event.

In the event of injury or illness the Organiser may, at the Ticket Holder’s cost, arrange medical treatment and/or emergency evacuation as deemed essential for the Ticket Holder’s safety.

There is free water and sunscreen provided on site at various locations inclusive of first aid locations.

The Organiser recommends that due to noise levels, ear plugs should be carried/worn by patrons. Offensive language may be used by some performers and artists.

Strobe lighting effects will be used as part of the festival’s production.

Where rides are on site, rides will be ridden at Ticket Holder’s own risk.

Any and all footage taken by patrons on camera, mobile phones or any recording device is subject to copyright laws. The Organiser and its artists give no permission for filming, photographing or recording and usage of any public medium without written authorisation from the Organiser will result in prosecution.

By attending the Event and using our medical facilities, Ticket Holders consent to the Organiser having access to their medical information.

No third party promotional items including flyers, posters, stickers, wristbands or tickets are permitted for distribution at the event.

If Ticket Holders believe they have received inappropriate or unfair treatment, they’re encouraged to report the incident by contacting hello@lostparadise.com.au within two weeks of the Event.

 

4, TICKETING

All tickets sold are done so on the condition that Ticket Holders are bound by these terms and conditions of entry and such other rules, terms or conditions as may be published by the Organiser.

All tickets are sold exclusively through Lyte. Only tickets purchased from www.lyte.com will be honoured. Tickets obtained from any other source will be considered void.

The owner of the ticket must display the owner’s name. 

Tickets are non-refundable and non-exchangeable except as required by law or specified by the Live Performance Australia Ticketing Code of Practice.

Failure to purchase a ticket from an authorised outlet may result in refusal of entry.

The sale or re-sale of a ticket by the Ticket Holder (including online auction sites) without the prior consent of the Organiser is prohibited. The Organiser has an ongoing relationship with the police regarding the falsification of tickets to events. If you suspect you have purchased an invalid ticket please contact Lyte customer support immediately.

All Ticket Holders entering the Venue must have a valid ticket. Ticket Holders on site without a valid event ticket or event accreditation will be ejected immediately. One ticket is only valid for the admission of one person.

Forging a ticket to the Event will result in immediate rejection. The Organiser reserves the right to refuse entry if a patron has been previously ejected from one of their events. It is the sole discretion of the Organiser to allow banned patrons to attend future events. The Organiser has the right to pursue legal action if banned patrons continue to attempt to flout their ban.

The Organiser reserves the right to collect and retain information provided by Ticket Holders in accordance with the Privacy Act 1988 and may contact Ticket Holders regarding ticketing or other matters related to the Event.

The Organiser reserves the right to enforce published ticket purchase limits and cancel any tickets obtained above said limits by any one customer.

 

5, ENTRY

The Event is strictly an 18+ event. Upon entry, Ticket Holders must provide valid photo identification bearing the same name as printed on their ticket.

Ticket Holders are only permitted to attend the Event on the date(s) specified on their ticket.

The 4 day ticket permits entry to the Lost Paradise 2023 festival at Glenworth Valley, NSW on 28 Dec – 31 Dec 2023 (inclusive). 

The 3 day ticket permits entry to the Lost Paradise 2023 festival at Glenworth Valley, NSW, on 29 Dec – 31 Dec 2023 (inclusive).

ENTRY GATES OPERATING TIMES:
28 December Gates open 8am until 8pm
29 December Gates open 8am until 8pm
30 December Gates open 9am until 8pm
31 December Gates open 10am until 4pm 

FESTIVAL SITE OPERATING TIMES:
28 December 2pm – Midnight
29 December 8am – 3am
30 December 8am – 3am
31 December 8am – 3am
1st January   8am – Midday

All Ticket Holders must be off site by 2pm, January 1, 2023.

Accepted forms of photo identification are a current driver’s license, a current passport or a current proof of age card. The validity of photo identification will be determined by the Organiser at their complete discretion. Ticket Holders without valid photo identification will be refused entry to the Event or may be evicted from the Event without refund.

The Organiser reserves the right to deny admission to the holder of any ticket that appears to have been tampered with, counterfeited or duplicated.

A security search will be conducted upon entrance to the Event.

The Organiser reserves the right to refuse admission and to remove Ticket Holders from the Venue for any reason and confiscate any ticket or wristband, without refund.

Once Ticket Holders have entered the Venue, they must wear their Event wristband at all times. 

Anyone entering the Venue, or found onsite at the Event without a valid wristband, will be deemed to have trespassed and will be handed over to the police for charging. 

All vehicles entering the Venue must have the appropriate valid pre-purchased vehicle pass from www.lyte.com. The vehicle pass must be displayed as per the terms and conditions printed on the pass or as detailed on www.lyte.com.

Vehicles, bags, containers and other personal items will be searched at the entry to the Venue to check for any banned items. Banned items include glass, alcohol, weapons, umbrellas, selfie sticks, video cameras (including GoPros), couches, sofas and drones.

Ticket Holders being dropped off will be able to use the Lost Paradise shuttle bus to get up and down the hill. Each journey will cost $10 per Ticket Holder. Patrons being dropped off at the entrance run the risk of wait times. Book an authorised bus to avoid unnecessary wait times.

 

6, LIABILITY

The Venue is an inherently dangerous place that contains all manner of dangers which may result in loss or damage to your property, personal injury or even death. Upon entering the Venue, Ticket Holders release and indemnify the Organiser and the Landlord from any claim or liability of any nature in relation to injury or death, which might arise from entry to the Venue regardless of how the damage, injury or death is sustained or caused.

Any property or equipment brought into the Venue by Ticket Holders is brought in at their own risk and the Organiser is in no way liable for any loss of or damage to such property.

Transport to and from the Venue will be operated by independent parties and the Organiser is in no way liable for any action or omission by said parties.

The Organiser may record the Event. Attendance of the Event constitutes Ticket Holders’ permission to make full use of any recordings or footage taken without any recourse to you.

Ticket Holders will be exposed to loud music at the Event and the Organiser takes no responsibility for any hearing damage or loss.

Ticket Holders may be exposed to coarse language and shouldn’t enter the Event if likely to be offended.

 

7, CONDUCT

Lost Paradise has a No Dickhead policy which means look after yourself and others. Treat your fellow Paradisians with respect. Lost Paradise is a place to make friends and not break them. If you behave like a dickhead, then Lost Paradise is not the place for you. If you have mates who are dickheads, please leave them at home. People who behave like dickheads will be ejected from the event. 

Ticket Holders must not do anything which would result in the Organiser to be in default under the Lease with the Landlord. A breach of this Agreement will likely have the effect of causing the Organiser to be in default under the Lease.

No unauthorised trading is permitted within or near the Venue; this includes displaying trading signs, ambush marketing or any other unauthorised promotion.

Smoking is not permitted inside any public tents or structures. 

Swimming is only permitted in designated areas and whilst a lifeguard is present.

A total fire ban is in operation for the entire duration of the Event. No naked flames are permitted at the request of NSW Fire and Rescue.

Any incidents or inappropriate behavior must be immediately reported to the Organiser.

Ticket Holders must place any litter in the recycle or other bins provided throughout the Venue.

 

8, PROGRAM

Some areas of the Venue are not open as part of the Event and Ticket Holders must not enter fenced off areas, or areas to which access is denied.

The Organiser reserves the right to add, withdraw or substitute artists and vary any advertised program. No refunds or compensation will be made in such circumstances.

Admission to individual stages and venues at the Event is subject to capacity at the discretion of the Organiser.

The Event is an all weather event and will take place rain, hail or shine (unless the Organiser determines otherwise in its absolute discretion). You should be prepared for all weather conditions (including while camping). The geographical area in which the Event is situated may be subject to extremes of temperatures, in particular high temperatures during the day, and low temperatures during the night.

  

9, REFUND AND CANCELLATION POLICY

The Organiser reserves the right to change, add, withdraw or substitute artists in the Event line-up, vary the advertised program, the date, the entry and exit times, the amenities, the facilities, the attractions, the entertainment, the Event site and/or the campgrounds and/or the VIP areas for the Event at its discretion without prior notification.

The Organiser may deny admission to the Event site and/or campgrounds and/or VIP areas (including admission to a particular performance at the Event site) in accordance with the Event Terms or otherwise in its absolute discretion.

Except where required by law or in accordance with Live Performance Australia’s Ticketing Code Of Practice, there will be no refund of any Event Tickets or for any unused portion of an Event Ticket. This includes but is not limited to where there has been a variation to the Event, if you are refused entry to or evicted from the Event site or campground or VIP areas by the Organiser in accordance with the Event Terms, if you fail to attend the Event, if you arrive after the commencement of the Event, if you leave the Event site prior to the conclusion of the Event, if you do not camp for the full period in which your Event Ticket entitles you to campground access or if you purchase the incorrect type of Event Ticket.

If the Event is cancelled (in whole or in part) by the Organiser as a result of any act of God; extreme weather; bushfires; war; council or governmental rulings or decisions; actions or decisions of the police or other authorities; cancellation by the Venue owner, lessee or controller; or for any reason outside of the Organiser’s reasonable control, refunds shall be in the Organiser’s sole and absolute discretion where not already required by law or in accordance with Live Performance Australia’s Ticketing Code Of Practice.

 

10, PROHIBITED ITEMS 

Ticket Holders are not permitted to enter the Event with any items that breach these conditions or which may cause injury or nuisance to Ticket Holders, performers or any other person. Any prohibited items will be confiscated and you may be ejected. This includes (without limitation):

  • Glass items
  • Illegal drugs
  • Flares, fireworks, glow sticks, sparklers, laser pointers 
  • Gas cookers
  • Animals or pets (Guide Dogs in harness permitted)
  • Recording or filming devices
  • Weapons or dangerous objects 
  • Alcohol or open beverages (non-alcoholic liquids in sealed containers permitted)
  • Microplastics including glitter, microbeads and stick-on decorative body adornments
  • Couches, sofas or inflatables 
  • Tents, structures or other items that Ticket Holders intend to leave at the Venue 
  • Portable audio devices (mobile phones permitted)

 

11, LIQUOR LICENSING

In the interest of responsible service of alcohol, Ticket Holders who are deemed to be intoxicated will not be served.

Alcohol may only be consumed within the licensed area.

 

12, RECYCLING CREDITS

Ticket Holders may return their vessels to a recycling tent in return for credits to be used on other Event purchases. Once a vessel is redeemed for a credit, it will be crushed and removed from the Venue.

The offering of discounts and recycling tokens/credits/discounts is at the discretion of the Organiser and can be changed at any time. Tokens/credit/discounts received through recycling have no cash value beyond the Event.

 

13, COMPANION CARD POLICY 

Holders of a national or state issued Companion Card may request a companion ticket equivalent to the ticket type held by the Companion Card holder. Upon approval of request, the Organiser will issue companions a complimentary ticket to the event to accompany a person with a disability.

To request a Companion Card ticket, the following details must be sent to hello@lostparadise.com.au

  • Scanned copy of the Companion Card
  • Full name and date of birth of the carer
  • Full name and ticket number of the Ticket Holder
  • Contact email address for further communication and ticket distribution

14, GLENWORTH VALLEY HORSE RIDING

The Organiser accepts no liability whatsoever arising from services, including, but not limited to: horse riding, abseiling, kayaking, bushwalking and quad biking, offered and provided by the Landlord. People availing themselves of such services do so at their own risk and in accordance with the terms and conditions of the Landlord.

 

15, CAMPING

Campfires are not permitted. Campers will be required to abide by a sense of common courtesy towards others, particularly in relation to noise and disposal of effluent and rubbish. All items brought into the Venue by Ticket Holders must be removed by the Ticket Holder.

Ticket Holders must vacate the Venue by 2.00pm on 1st January 2023.

There are no gas cookers or naked flames allowed.

Ticket Holders must not camp underneath or near trees.

The approval of items entering the campsite will be at the discretion of the Organiser.

There will be adequate food, beverage and general store items to be able to be purchased at the Event.

No vehicles permitted on the campsite. All GA parking requires a Parking Pass.

To sleep inside ANY vehicle you will need a Sleep-In-Vehicle pass. No tents are allowed on the ground in the Sleep-In-Vehicle area.

There is no alcohol permitted in any campground.

 

PAYMENT PLAN TERMS & CONDITIONS

  • Do you have Payment Plans?
    Yes! On all orders, you’ll have the opportunity to choose a payment plan as the payment method for your order. Payment plans are provided by Klarna, and split the total cost of your order into 4 x fortnightly instalments.

    If you already have an existing Lost Paradise order made before August 1st and wish to switch to pay via the payment plan, all you’ll need to do is:
    1. Log into your Lyte order after August 1st
    2. Under the payment section, click “Edit” and select “Pay with Klarna”
    3. Follow the Klarna guidelines to confirm your payment plan

    Please note: you will not be able to switch to the payment plan after your order has been processed and payment has been taken.

  • How does it work?

    Payment Plans are provided by Klarna.

    To purchase tickets with a payment plan simply select your ticket (and any add-ons) and add them to your cart. During the checkout, you will be given the option to choose to pay via Payment Plan via Klarna as your payment method. This will surface more information about the payment plan and split the cost of your instalments as specified.

    Payment Plans cannot be added once your order is confirmed and payment has been taken.

    Please note that Klarna may make a hold on your first instalment in order to validate your bank account when making your ticket reservation. If you decide to cancel your reservation before your order is confirmed, this amount will be released back to you. Please see the Klarna terms for more information.
